Residents of District No 33 Have Addressed to Saribek Sukiasyan

Owners of alienated properties from 33rd District have sent an application to Saribek Sukiasyan, Candidate of RA National Assembly Member:

It goes as follows:

Dear Mr. Sukiasyan,

At the decision No 108 of 25.01.2001 and on bases of contract concluded with the mayor of Yerevan, according to RA Law on Alienation of Property for the Needs of Public, the City Center Development CJSC has been recognized as purchaser of the alienable property for implementing an urban building program in the mode defined by the law.

The purchaser City Center Development Company has concluded contracts with a number of residents form 33rd District about private property alienation for the public and state needs. According to contracts the company obliged to provide the owners with decorated apartments and public areas against their alienated private property within periods of 42 months (3.5 year) in the manner defined in the contracts.

The owners of the alienated property from 33rd District have applied themselves to City Center Development Company as the acquirer, to provide information about the progress of construction of the multi-apartment building to be built in 33th District.

A number of meetings took place between the above mentioned owners and the employee of   City Center Development Company Vahagn Tadevosyan, Deputy Director Tigran Asriyants and Director Tigran Pinajyan.

They motivated the delay of work with the preparatory works (project documentation setting, implementing of engineering–geological researches   on site, excavating works etc.) necessary for construction.  These and other similar responses have arisen the anger of the owners of the alienated properties, because the validity period of the contracts between them and City Center Development CJSC has expired long ago.

During 4 years the company has excavated one hole without carrying out any building work. This evidences obviously that the purchaser City Center Development Company has violated its obligations stipulated in the contract.

We would like to point out that the mayor is the state authorized coordinator the process of alienation of property according to the Decision No. 108 of   25.01.2007 of RA Government. The mayor of the city also represents the Republic of Armenia in the contract between himself and City Center Development CJSC according to contract dated 24.01.2007. The said contract is the integral part of the above decision of the government.

On 16 April 2012, a collective appeal was sent to S. Sargsyan RA President, S. Nikoyan Chairman of the National Assembly, T. Sargsyan Prime Minister, T. Markarian Yerevan Mayor, K. Andreassyan Ombudsman of the Human Rights with the request to immediately interfere and protect our legitimate interests, as well as take up measures to City Center Development Company to carry out his contractual obligations.

We consider it necessary to emphasize the fact that although the law provides compensation against the alienated property, but we were offered a non- preliminary variant of concluding contracts  to be e provided with apartments and public areas from the residential buildings to be built on the place of our properties.

At the same time, the company paid a minimum monthly fee for renting temporary residential area. We were forced to conclude that contract under the threat of being evicted from our properties although the purchaser’s proposal was contradicting the RA Law on compensation against the alienated property for public and state needs. So far we do not understand why our government, while implementing state program in our district, has given the right of forced alienation from our properties to City Centre Development Company without safeguarding the legitimate interests of the owners.  As a result several dozen of owners found themselves in a difficult situation, one can say in status of a “vagrant”.

We ask you, as a MP candidate, to include our problems in your pre-election program and support our legitimate interests.
